1. Introduction

Welcome to Festestockco. These Terms and Conditions govern your access to and use of www.festestockco.com and purchases made through our website.

Throughout these Terms, “Festestockco”, “we”, “us” and “our” refer to the business operating under the Festestockco brand. “You” and “your” refer to any person visiting our website or purchasing our products.

By placing an order, you agree to the terms applicable to that purchase. Please read these Terms carefully before completing an order.

These Terms are to be read alongside our Privacy Policy, Shipping Policy and Returns and Refunds Policy. If any provision conflicts with a mandatory legal right applicable to your purchase, that legal right shall prevail to the extent of the conflict.

2. Our Products

Festestockco offers party and festive decoration supplies for birthdays, seasonal celebrations, family gatherings and other occasions.

Product descriptions, photographs, dimensions, quantities, package contents, prices and available options are provided on the relevant product pages. Customers should review this information before placing an order.

We take reasonable care when preparing product descriptions and displaying product images. Actual colours and visual details may vary slightly depending on screen settings, lighting and the device used to view the website.

Any such variation does not affect your statutory rights where a product does not conform to its description or the agreed purchase terms.

We reserve the right to update product listings, availability information and prices before an order is accepted. Changes will not retrospectively alter an order already accepted, except where permitted by law or agreed with the customer.

3. Eligibility and Website Use

By placing an order, you confirm that you are legally capable of entering into a binding contract under the laws applicable to you.

You agree to use our website for lawful purposes and to provide accurate information when placing an order.

You must not knowingly submit false order details, interfere with the operation of the website, attempt to gain unauthorised access to website functions, or use the website in connection with unlawful activity.

We may take reasonable and proportionate action where there is credible evidence of misuse, fraudulent activity or a material breach of these Terms. Any action affecting an existing order will remain subject to applicable law.

4. Orders and Contract Formation

When you submit an order, you are making an offer to purchase the selected products at the stated prices and on the terms displayed during checkout.

An order confirmation email acknowledges receipt of your order. Acceptance of the order and formation of the sales contract will be indicated through our order acceptance process.

We reserve the right to decline or cancel an order before acceptance where there is a genuine reason, including an apparent pricing error, unavailable products, incomplete order information or a reasonable concern regarding fraudulent activity.

If payment has already been collected for an order that is cancelled, we will arrange a refund of the amount due through the original payment method, subject to applicable law.

If an issue arises after an order has been accepted, we will contact you where appropriate and handle the matter in accordance with the applicable contract and legal requirements.

Customers are responsible for reviewing their order details, delivery address, selected products and quantities before submitting an order.

If you identify an error after ordering, please contact stock@festestockco.com promptly. We will consider your request in light of the order’s status and applicable law.

5. Prices and Payments

All product prices and applicable delivery charges will be displayed during checkout before you complete your purchase. The applicable currency, taxes and additional charges will be shown where required.

You are responsible for reviewing the final order total before submitting your payment.

We use Stripe as our payment processor to facilitate payments made through our website. Available payment methods are displayed during checkout.

By submitting a payment, you confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate.

Payment authorisation, transaction processing and confirmation are subject to the relevant payment arrangements. We may retain transaction references and payment records as necessary for order administration, accounting, refunds and compliance with applicable law.

If a payment is declined or cannot be completed, the order may remain unconfirmed until the payment issue has been resolved.

Refunds will generally be issued to the original payment method, subject to applicable law and the payment method’s operational requirements.

6. Shipping and Delivery

6.1 Order Preparation

Orders are processed after order confirmation and successful payment, where applicable. Processing time may vary according to the order and product availability.

The applicable processing information will be stated on our website or communicated with the order details where relevant.

6.2 Delivery Services and Estimated Transit Time

We work with established delivery services, including DHL, FedEx and UPS Priority services, depending on the destination and available service arrangements.

For orders dispatched from Singapore to eligible European destinations, the estimated transit time is 5–12 business days from dispatch.

This estimate refers to transit time and does not necessarily include order preparation, customs processing where applicable, public holidays or other periods outside the carrier’s normal transit schedule.

Delivery estimates are provided to help customers plan their purchases. The delivery period applicable to an individual order will also take account of any specific delivery date or period agreed at checkout.

Where no different period has been agreed, applicable statutory delivery requirements will apply.

6.3 Tracking Notifications

We send tracking notifications to the email address supplied at checkout when relevant tracking events become available.

Notifications may include:

  • Order dispatch.
  • Arrival at a carrier facility or other recorded logistics checkpoint.
  • Progress through the delivery network.
  • Arrival in the destination area and local delivery updates.

The availability and timing of individual notifications depend on the information supplied by the carrier.

Customers should check their inbox and junk or spam folders for order-related messages. If tracking information is unavailable or appears inconsistent, please contact stock@festestockco.com.

6.4 Delayed, Missing or Unreceived Orders

If an order exceeds the stated transit estimate or tracking indicates an unusual delay, please contact us with your order number.

We will review the available tracking information and, where appropriate, open an enquiry with the relevant carrier.

Following the investigation and consideration of the circumstances, we may arrange a replacement or a full refund where appropriate. If the order is legally considered undelivered, any applicable statutory remedies and deadlines will apply regardless of the carrier investigation.

If delivery does not take place within the agreed period, or within the applicable statutory period, you may have the right to require delivery within an additional reasonable period or terminate the contract and obtain a refund as provided by law. Where delivery by a particular date was essential and the applicable legal conditions are met, different remedies may be available.

We will not treat a carrier’s possession of a parcel as proof that the customer has received it.

6.5 Risk of Loss or Damage in Transit

Where applicable European consumer law governs the transaction, the risk of loss of or damage to the goods remains with Festestockco until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

The risk may pass earlier only where the customer independently commissions a carrier that was not offered by Festestockco, to the extent permitted by applicable law.

Nothing in these Terms transfers the risk to the customer merely because the goods have been handed to a carrier selected or arranged by us.

6.6 Delivery Information

Customers are responsible for supplying a complete and accurate delivery address and contact information.

If delivery is affected by an incorrect address or incomplete information provided by the customer, we will review the circumstances and any available carrier options. Any additional charges or remedies will be handled in accordance with the information provided before purchase and applicable law.

This provision does not remove any legal obligation that remains with Festestockco.

7. Right of Withdrawal: 14 Days

7.1 Your Right to Withdraw

Where the European Union’s consumer withdrawal rules apply, you generally have the right to withdraw from an online purchase within 14 days without giving a reason.

For goods, the withdrawal period generally begins on the day you, or a third party designated by you other than the carrier, take physical possession of the goods.

Where an order contains multiple goods delivered separately, or goods delivered in separate lots or pieces, the relevant statutory rules determine when the period begins.

Certain statutory exceptions may apply to particular categories of goods. Any exception will be applied only where the relevant legal conditions are met.

7.2 How to Exercise the Right

To exercise your right of withdrawal, please email stock@festestockco.com within the applicable withdrawal period.

Please include:

  • Your name.
  • Order number.
  • The product or products you wish to return.
  • A clear statement that you wish to withdraw from the purchase.

You may use the model withdrawal form provided at the end of these Terms, but you are not required to use that form if your message clearly communicates your decision to withdraw.

We will acknowledge your request where appropriate and provide the return instructions and address.

7.3 Returning the Goods

Unless we offer to collect the goods or applicable law provides otherwise, you must send the goods back without undue delay and no later than 14 days after notifying us of your withdrawal.

You may be responsible for the direct cost of returning goods following a change-of-mind withdrawal, provided that you were informed of this obligation before purchase as required by law.

Returned goods should be handled only as necessary to establish their nature, characteristics and functioning. You may be liable for a reduction in value resulting from handling beyond what is necessary for that purpose, where permitted by law and where the required information about withdrawal rights has been supplied.

Nothing in this section limits any separate remedy available for goods that are faulty, damaged or not as described.

7.4 Refunds Following Withdrawal

When you validly exercise the right of withdrawal, we will reimburse payments received for the relevant purchase, including the cost of the least expensive standard delivery option offered, where required by law.

We may withhold reimbursement until we have received the returned goods or you have supplied evidence of having sent them back, whichever occurs first, unless applicable law requires otherwise.

Refunds will be made without undue delay and, where the EU withdrawal rules apply, generally no later than 14 days after we are informed of your decision to withdraw, subject to the permitted withholding conditions above.

Refunds will normally be issued using the original payment method unless another method is agreed that does not impose additional costs on you.

8. Damaged, Faulty or Incorrect Goods

We take order enquiries concerning damaged, faulty, missing or incorrect products seriously.

If your order arrives with visible damage, contains an incorrect item, or a product appears to have a fault, please email stock@festestockco.com and include:

  • Your order number.
  • A description of the issue.
  • Clear photographs showing the affected product and, where relevant, its packaging or the incorrect item received.

Photographs help us assess the issue and determine the appropriate next step.

Where the evidence is sufficient, we may resolve the matter without requiring the affected item to be returned. Depending on the circumstances, this may involve a replacement, refund or another remedy permitted by applicable law.

If further assessment is reasonably necessary, we will explain the next steps. Any request to return an item will be handled in accordance with the applicable legal requirements, including the rules on return costs for faulty or non-conforming goods.

8.1 Statutory Remedies

Where EU consumer sales legislation applies, customers have statutory rights when goods are faulty or do not conform to the contract.

Depending on the circumstances and the applicable national rules, remedies may include repair, replacement, a price reduction or termination of the contract with a refund.

Any remedy will be provided in accordance with the applicable statutory conditions and time limits. Where a remedy for non-conforming goods must be provided without charge, the customer will not be required to bear costs that the law places on the seller.

The voluntary process of submitting photographs described above is intended to help us review a claim efficiently. It does not remove a customer’s statutory rights or impose an additional legal condition on exercising those rights.

9. Refund Administration

Approved refunds are normally returned to the original payment method.

The time taken for a refund to appear in your account may depend on the payment method and the relevant financial institution. We will initiate the refund within the period required by applicable law.

For a return or refund enquiry, please provide your order number and a description of the matter so that we can locate the relevant transaction.

Where only part of an order is affected, any partial refund or other remedy will be assessed in accordance with the circumstances and applicable law.

We reserve the right to review requests against order records, correspondence, tracking information and relevant product evidence. This review process will not be used to delay or deny a remedy that is legally due.

10. Cancellations

If you wish to cancel an order before dispatch, please contact stock@festestockco.com as soon as possible and include your order number.

We will review the order status and advise whether cancellation can be processed before dispatch.

Once an order has been dispatched, the ordinary pre-dispatch cancellation process may no longer be available. However, you may still exercise any applicable statutory right of withdrawal or other legal remedy.

Nothing in this section limits a customer’s right to terminate a contract where such a right is provided by applicable law, including where goods have not been delivered within the legally required period.

11. Promotions and Price Changes

From time to time, we may offer promotional prices or special offers on selected products.

Any promotion will be subject to the conditions, eligibility criteria and validity period stated in the relevant offer.

Promotional offers cannot be applied retrospectively to completed purchases unless the stated promotional terms or applicable law provide otherwise.

Where required by applicable law, advertised price reductions and reference prices will be displayed in accordance with the relevant pricing rules.

We reserve the right to end or amend a promotion prospectively where permitted by law. Such changes will not remove rights already acquired under a completed purchase.

12. Intellectual Property

The text, photographs, graphics and other materials published on www.festestockco.com may be protected by applicable intellectual property laws.

Except where permitted by law or with the relevant rights holder’s permission, website materials must not be reproduced, distributed or commercially exploited without appropriate authorisation.

Purchasing a product does not transfer ownership of any intellectual property associated with the website or its materials.

This section does not restrict any use permitted under applicable law.

13. Limitation of Liability

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

Subject to that requirement, Festestockco will be responsible for losses that are reasonably foreseeable and arise from a breach of the applicable sales contract or a failure to meet a legal obligation.

To the extent permitted by law, we will not be liable for losses that are not reasonably foreseeable, or for losses arising solely from circumstances outside our contractual responsibility and not otherwise attributable to a legal breach by us.

Nothing in this section limits liability for fraud, fraudulent misrepresentation, wilful misconduct where liability cannot lawfully be excluded, or any other liability that cannot be restricted under applicable law.

Consumers retain all mandatory statutory rights applicable to their purchases.

14. Events Outside Our Reasonable Control

Where circumstances outside our reasonable control affect the performance of an obligation, we will consider the nature of the event, its duration and the available options for fulfilling the order.

Such circumstances may include severe transport disruption, natural events, public emergencies or interruptions affecting relevant delivery services.

We will communicate material delays where reasonably practicable and consider the remedies available under the contract and applicable law.

This section does not permit us to disregard statutory delivery deadlines, refund obligations or other mandatory consumer protections.

15. Privacy and Personal Data

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws.

Information supplied during checkout may be used to administer orders, process payments and refunds, arrange delivery, respond to enquiries and maintain records required by law.

Stripe processes payment-related information in accordance with its applicable privacy terms and the role it performs for the relevant activity.

For further information about personal data, data retention, cookies and applicable rights, please refer to our Privacy Policy and Cookie Policy.

16. Complaints and Dispute Resolution

If you have a concern about an order or these Terms, please contact us first at stock@festestockco.com.

Please include your order number, a description of the issue and any relevant supporting information. We will review the matter and respond within a reasonable period, taking account of any applicable statutory deadline.

Nothing in this section prevents you from seeking assistance from a competent consumer protection authority, pursuing a claim before a competent court or exercising any other remedy available under applicable law.

Where an alternative dispute resolution procedure is available and applicable, information about the relevant procedure may be provided upon request or as required by law.

17. Governing Law and Jurisdiction

These Terms are intended to be interpreted consistently with the laws of Singapore and any mandatory laws applicable to the relevant transaction.

Where a consumer habitually resides in an EU Member State and the conditions of applicable European conflict-of-law rules are met, a choice of Singapore law will not deprive that consumer of the protection afforded by provisions that cannot lawfully be derogated from under the law that would otherwise apply.

Any dispute shall be submitted to a court with jurisdiction under the applicable legal rules. Nothing in these Terms removes a consumer’s right to bring proceedings before a court where such a right is provided by mandatory law.

18. Changes to These Terms

We may revise these Terms when our business practices, products or applicable legal requirements change.

The updated version will be published on www.festestockco.com with a revised date. Changes will apply prospectively unless otherwise permitted by law or agreed with the customer.

The terms applicable to an existing order will not be changed retrospectively in a way that unlawfully reduces the customer’s rights.

We encourage customers to review the current version before placing a new order.

19. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the extent necessary where legally permissible.

The remaining provisions will continue to apply to the extent that they remain valid and enforceable.

This section does not authorise any provision to override mandatory legal requirements.

20. Entire Agreement

These Terms, together with the policies and purchase information expressly applicable to an order, form the contractual framework governing the relevant purchase.

In the event of an inconsistency, mandatory legal requirements prevail. Any specific order terms agreed with the customer will apply to the extent that they lawfully vary these general Terms.

Nothing in this section excludes rights or remedies that cannot lawfully be excluded.
